To make sure we know what to expect from each other, DocumentRequest has written down the terms and conditions that apply when it provides services to its users. By using the Website or the Service you agree to be bound by this Terms and Conditions. The language of the Agreement is exclusively English and any translations must follow the original meaning.
The Terms and Conditions (the “Agreement”) is an agreement between you (“You”, “Your”, etc.), the user of our document request service (the “Service”) provided through the website or domain documentrequest.cloud (“Website”) and “PUINT di G.B.” (“DocumentRequest”, “We”, etc.), with its office at Via Taboga 245 Gemona del Friuli (UD) Italy, registered at the Italian Chamber of Commerce under XXYY. “PUINT di G.B.” is the provider of the Service but not the owner and rights holder of the Website, IT platform and “DocumentRequest” brand. The recipient who receives Your document request is called “Document Provider”.
DocumentRequest provides You with the infrastructure and facilities the management of documents you need from the Document Provider. Each document request involves only one reply from the Document Provider by which one or more documents can be uploaded by the Website. Through the Website, You can receive files up to 2 gigabyte (GB) per each document request You did to the Document Provider. DocumentRequest manages all kinds of electronic documents, subject to these Terms and Conditions. Uploaded files are stored and available to download on servers utilized by DocumentRequest, for a period of 14 days from the “due date” You planned for Your document request. After this period files are permanently deleted.
Any document management is treated confidentially. DocumentRequest will not look into the documents obtained from the Document Provider, unless this is necessary according by law or to provide You with technical support on your request. Please be careful to distribute download access.
DocumentRequest takes appropriate technical and organizational measures to protect both Your personal data and the documents uploaded by the Document Provider, against loss or other forms of unlawful processing. The servers we use are located in EU, Italy.
DocumentRequest uses only PSR-2 compliance code and highly secure connections every time. The connection is provided through an SSL certificate, witch encrypt every data client-server comunications with the most modern encryption technology by Comodo.
Your registration in the Website is mandatory and Your account will be cancelled after two years from the last subscription. You may decide to recede from the Agreement by canceling your account. The subscription fee for a pack of 100 document requests is 5 EUR, excluding VAT. You may choose from packs of 100, 300, 500 or 1000 document requests and in any case, You pay 5 cents (excluding VAT) per each document request. The payment is done online through PayPal and automatically an invoice or a confirm of the transaction will be sent to You.
If You are registered in DocumentRequest as a natural person, You agree to waive any right to request the issue of an invoice, then agree to receive an email confirming the purchase transaction. If You are registered in DocumentRequest as a company or entity, You agree to receive the invoice only in PDF format, by email, then waive other forms of document and transmission. If You are registered in DocumentRequest as a company or entity located in Europe: a) You are aware of the obligation to be registered in the VIES system and that the execution of intra-Community transactions without having VIES involves the violation of national and Community law; b) to this end, We inform You that We are resident in Italy; c) in order to benefit from the Service, even without your VIES, You agree to receive an invoice including VAT of 22%; c) You accept to relieve us from any tax liability as a result of your conduct and to refund any charges and penalties that would arise as a result of tax audits.
You are aware the use the document requests included in the pack is available for a period of 365 days from the date of payment, after this period the document requests you have not used will be cancelled and Your credit will not be refunded. If You recede from the Agreement the remaining credit will not be refunded.
You are aware that through the Service you may request confidential information that the Document Provider may refuse to upload in the Website, so it is your responsibility to make sure that the Document Provider is available to meet your request via DocumentRequest. In any case, DocumentRequest is not responsible for the failure to use the Service by the Document Provider.
DocumentRequest does not claim any ownership of the contents of the files You receive through our Service. You and the Document Provider are fully and solely responsible and accountable for the documents managed through our Service. By using our Service the Document Provider is requested to confirm that he/she/it has, for each document, all required permissions, including from copyright and other intellectual property rights holders, to distribute, transfer, store and/or make available online as part of our Service and You guarantee that You have the right to request and obtain those documents. DocumentRequest respects Your and Document Provider rights and demands that you all respect those of DocumentRequest, its artists, advertisers and third parties. This includes respecting the right to privacy, corporate intelligence and business secrets and intellectual property rights, such as trademarks, service marks, trade names and logos. You all agree not to use the Services to commit or promote, enable or facilitate unlawful or criminal acts or violations of these Terms and Conditions or facilitate or promote others to do so. In any case, you agree to keep DocumentRequest free for any damage, claim or injury to third parties as a result of inappropriate use of the Service. As a condition to make use of the Service You will avoid asking or will promptly cancel any document from the Document Provider that:
It is Your duty and responsibility to inform the Document Provider that, with the use of the Service, he/she/it will confirm the acceptance of the following clauses included in this Agreement:
DocumentRequest provides its Service “AS-IS”, without warranty of any kind. Without limiting the foregoing, DocumentRequest explicitly disclaims any warranties of merchantability, fitness for a particular purpose and non-infringement. DocumentRequest makes no warranty that the Service is available on an uninterrupted, secure or error-free basis. Your use of the Service is at Your own risk. You acknowledge and agree that DocumentRequest is not responsible for any damages to Your computer system or the computer system of any third party (included the Document Provider) that result from use of the Service and is not responsible for any failure of the Service to store, transfer or delete a document or for the corruption or loss of any data, information or content contained in a document.
You will defend, indemnify and hold harmless DocumentRequest, including its employees and affiliates, from and against any claims, incidents, liabilities, procedures, damages, losses and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with Your access, or the accesso of Your delegate, to or use of the Service or Your violation of these Agreement, including any third party claims that files submitted to the Service infringe or violate any third party rights. However, this limitation of liability does not intend to exclude the liability of DocumentRequest for the intentional and/or deliberate recklessness of DocumentRequest themselves (“their own acts”) and or the management of DocumentRequest. In no event will DocumentRequest be liable to You or to any third party for any damages arising out of use of the Website or Service, whether based on warranty, contract, tort (including negligence) or any other legal theory and whether or not DocumentRequest has been informed of the possibility of such damage, even if any limited remedy is found to have failed its essential purpose. DocumentRequest will not accept any liability for damage as a result of an attributable failure in the performance of the Agreement to provide the Service or pursuant to an unlawful act or whatever other reason, including, but not limited to any incidental, special, consequential damage resulting from or in connection with the use of the Service and/or the impossibility of using it insofar as this is allowed under mandatory law.
All rights and obligations arising out of or in connection to these Agreement are construed, governed, interpreted and enforced according to the laws of Italy. The exclusive jurisdiction and venue of any action with respect to any subject matter relating to these Terms and Conditions will be the courts located in Udine, Italy. You waive any objection to jurisdiction and venue in the courts of Italy.
Note that DocumentRequest may revise these Agreement from time to time. Each revised version shall be dated and posted on the Website. DocumentRequest recommends that You review the Website from time to time and take note of any changes. If You do not agree with the changes, You should not or no longer access or use the Website and/or Service. By continuing to use the Website and/or Service You accept any changes made to the Agreement.
